§1 Anbieter / Seller

§2 Scope of Application / Geltungsbereich
These Terms and Conditions apply to all contracts concluded between Tutu and Tiaras Shop and the customer via the online shop at tutu-and-tiaras.shop. Deviating terms of the customer are not recognised unless Petit Pirouette expressly agrees to their validity in writing.
§3 Ordering Process / Bestellvorgang
The products presented in our online shop do not constitute binding offers but are merely an invitation to submit an offer (invitatio ad offerendum). By placing an order via our online shop, the customer submits a binding offer to conclude a purchase contract.
The ordering process comprises the following steps:
- Selection of the desired products
- Adding products to the shopping cart
- Entering shipping and billing address
- Selection of payment method
- Review and confirmation of the order
Upon submission of the order, the customer receives an automatic order confirmation by email. This confirmation serves as a notification that the order has been received, but does not constitute acceptance of the offer. The purchase contract is formed when we dispatch the ordered products and send a shipping confirmation email, or upon explicit acceptance of the order.
§4 Prices / Preise
All prices quoted in our online shop are in Euros (EUR) and include the applicable statutory value added tax (VAT). Shipping costs are displayed separately during the ordering process and are borne by the customer unless otherwise stated (e.g., free shipping promotions).
§5 Shipping / Versand
We ship within the European Union (EU). Delivery times and shipping costs are displayed during checkout and may vary depending on the destination country and shipping method selected. Unless a specific delivery date is confirmed, delivery shall be made within 30 days of the order. We are not responsible for delays caused by the shipping carrier or force majeure.
Risk of loss or damage to the goods passes to the customer upon handover to the shipping carrier.
§6 Right of Withdrawal / Widerrufsrecht
Consumers have a statutory right of withdrawal in accordance with the applicable EU consumer protection regulations. You may withdraw your contractual declaration within 14 days without giving any reasons by informing us of your decision to withdraw.

§7 Payment Methods / Zahlungsarten
We accept the following payment methods:
- Credit card (via Stripe)
- Debit card
- Other payment methods as displayed during checkout
Payment is due immediately upon conclusion of the contract. Payment data is processed securely through our payment service provider. We do not store credit card details on our servers.
§8 Retention of Title / Eigentumsvorbehalt
The delivered goods remain our property until full payment has been received.
§9 Warranty / Gewährleistung
The statutory warranty provisions apply. In the event of defects, the customer is entitled to the statutory rights for subsequent performance (repair or replacement). The limitation period for warranty claims is two years from delivery of the goods.
§10 Liability / Haftung
We are fully liable for damages arising from injury to life, body, or health, as well as for damages based on an intentional or grossly negligent breach of duty by us, our legal representatives, or vicarious agents.
For slightly negligent breaches of duty, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, typically occurring damage.
Liability for slight negligence is otherwise excluded. The above limitations do not apply to liability under the German Product Liability Act (Produkthaftungsgesetz) or for fraudulently concealed defects.
§11 Final Provisions / Schlussbestimmungen
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Leverkusen, Germany, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected thereby.
